Terms: TERMS AND CONDITIONS FOR ONLINE AUCTION

Registration:
Bidder and Auctioneer agree that the terms listed below shall govern the online auction sale.
All bidders participating in this auction agree that they have read and fully understand these terms and agree to be bound thereby. All bidders are required to electronically register for bidding on this site. All registration information the Bidder provides to the Auctioneer shall be current, complete and accurate. Bidders must be 18 years of age or older. If applicable, State and local Sales tax will be charged unless the auctioneer is presented with a valid exempt use or resale certificate. All sales are subject to appropriate State Tax Laws; Buyer must acknowledge and agree not to retract the purchase offer.

When Bidder places a bid on an auction being operated by Auction Liquidation Services; Bidder is entering into a contractual agreement with the Owner/Seller. Therefore, unless Bidder intends on being legally obligated to purchase the item(s) on which Bidder places a bid, Bidder should not place the bid. If Bidder does place a bid and fails to comply with the contractual agreement, Bidder agrees to be subject to the laws of the State of New Jersey, County of Monmouth. All bids are binding, even if outbid, until the transaction of the highest legitimate bidder is completed with the Seller/Owner. In the case that the highest bid is considered fraudulent or the high bidder defaults on their bid, the Owner/Seller will have the option of either selling to the next highest bidder , or canceling the auction. Auctions which close with a bid that is below the Reserve Price of an auction are the only exception to this policy, in which case neither the Owner/Seller nor the Bidder are obligated to complete the transaction normally.

Closing:
This auction begins ending at 6:00PM on Friday, April 16, 2010. The first item will close at 6:00 PM, the second item will close at 6:01PM, the third item will close at 6:02PM and so on until all items are closed. You will receive an email no later than Monday morning if you are the winning bidder, with instructions on how to make payments and special instructions for approval process from the LEA.

We have add a new feature called extended bidding. This feature will leave the bidding open for 3 minutes on any item that has received a bid within the last minute from the last recorded bid time, even if the the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more like a 'live' auction.


APPROVAL PROCESS:
After approval of purchase price by the Delaware State Police the prospective buyer is responsible for completing the DLA Form 1822 (End User Certificate), providing a copy of the recipient’s driver license and submitting it to the Law Enforcement Agencies (LEA). If the DLA Form 1822 is completed on behalf of a corporation or business, the person executing the DLA 1822 must submit a copy of the authorization to sign documents on behalf of the business or corporation with the complete form. The DLA Form 1822 must be completed with all requested information and be legible. Instruction on how to complete the form are located at https://demil.osd.mil.
The Trade Security Controls Assessment Office (TSCAO) assessment is not an approval of disapproval of the sale, auction, or trade. It can however result in a recommendation to the Law Enforcement Support Office ( LESO) to disapprove the proposed sale or trade based on the legal status of the prospective buyer or trade recipient. The assessment takes a minimum of 45 day.
The LESO approves or disapproves the request based on the LEA’s request packet, State Coordinator’s written recommendation and TSCAO’s recommendation. The LESO then sends the approval or disapproval in writing to the State Coordinator.

Payments:
All bidders understand that all items up for auction are subject to Agencies confirmation. There is also a Special Approval process (listed above) the winning bidder must go through before approval to purchase. The high bidder will be notified no later than Monday Morning April 19, 2010 of the Sellers confirmation. High bidder will have to make a 10% deposit within 2 days of the confirmation email being received. Payments are to be made by wire transfer only. The approval process could take up to 45 days. After the Approval from LEA final payments will be due within 10 days. There will be NO Direct Deposits.

Late payment; failure to complete sale:
If the winning bidder fails to pay the purchase price and other associated fees before the payment deadline then the winning bidder must pay to Auction Liquidation Services a late fee equal to 2% of the purchase price. If the winning bidder fails to make full payment of the purchase price and other fees within five (5) days after the auction, such winning bidder shall be deemed in default of its obligations in connection with the bid and shall forfeit its rights to purchase the goods, in which case the Seller may sell the goods to another bidder. If the winning bidder is in default as set forth herein, a Default Penalty will be assessed to the winning bidder in the amount of $1,500 or the dollar amount of the invoice, whichever is less, and the winning bidder will be barred from bidding on other auctions on the marketplace until the Default Penalty is paid. The Default Penalty must be paid to Auction Liquidation Services by cashier’s check or wire transfer. In the event of a default as set forth in these Terms and Conditions and as is allowable in accordance with the laws of the State of New Jersey, the winning bidder may be subject to other claims, damages or liabilities to the Seller and/or Auction Liquidation Services.

Removal:
Once the final approval has been made by the LEA then bidder must notify US Gov Bid to make an appointment for final removal date.

Descriptions:
The descriptions of item/lots appearing in the auction and in advertising prior to the auction are believed to be correct. Nevertheless, the Auctioneer is not responsible for the correct description,year, make, model, vin#, authenticity, genuineness or defects in any lot and makes no warranty. ALL SALES ARE FINAL. No deduction will be allowed on damaged articles as all goods being exposed for public auction are sold “as is”, “where is” and with all faults. Bidder acknowledges that all item/lots were available for inspection prior to the auction and the Auctioneer and Owner/Seller strongly encourages the Bidder to carefully inspect each item/lot in which the Bidder has any interest to determine the item/lots condition, quality and size. Bidder relied solely on personal inspection and not on information listed on the Site or otherwise provided by Auctioneer or Owner/Seller. Bidder’s failure to inspect or to be fully informed will not constitute grounds for any claim, adjustment, and refund, termination of the contract for sale or refusal to close the sale, against Auctioneer or Owner/Seller.

Auctioneer cannot and will not be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free services or use of the Site. Bidder acknowledges that the auction is conducted electronically and relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final.

Auctioneer gathers information about Bidders and Owner/Sellers for the purposes of conducting online auctions. Auctioneer does not sell or rent this information.
